A delegation from the Federation of UT Employees and Workers submitted a memorandum to the ADC,
demanding that outsourced personnel working across all departments be granted the basic pay scale and Dearness Allowance (DA) corresponding to their specific categories, rather than merely the DC rates.
Chandigarh 16 April ( Ranjeet Singh Dhaliwal ) : The Federation of UT Employees and Workers, Chandigarh, submitted a memorandum addressed to the Deputy Commissioner and the Labour Commissioner, demanding that outsourced personnel working in various departments across Chandigarh be granted the basic pay scale and Dearness Allowance (DA) applicable to their respective categories. In this regard, citing Letter No. U1328/39/2000-Chandigarh Vol. II, dated November 22, 2001, issued by the Ministry of Home Affairs, Government of India, the Federation argued that since the Central Government has already taken a decision to this effect—and has issued directives to the Administration accordingly—and given that this decision is already applicable to daily-wage workers, there is no justification for not extending its applicability to outsourced personnel working in various departments.
In connection with this matter, a delegation from the Federation met with the ADC of the Administration. The representatives emphatically asserted that the principle of "Equal Pay for Equal Work" has been in force in Chandigarh since 1990. Furthermore, they highlighted that the Supreme Court of India has delivered verdicts regarding both regularization and "Equal Pay for Equal Work" in several landmark cases, including Uma Devi vs. State of Karnataka, Jaggo vs. UOI, Sampat Singh, and Jagjit Singh. While this judicial mandate is already being implemented for most categories of employees at the PGIMER (Postgraduate Institute of Medical Education and Research) in Chandigarh, the formula of "Equal Pay for Equal Work" is regrettably not being applied within the departments functioning under the Chandigarh Administration and the Municipal Corporation.
The Federation termed this disparity as unfortunate and discriminatory, alleging that the Administration is perpetrating an injustice against temporary personnel; instead of formulating a comprehensive policy for regularization and ensuring "Equal Pay for Equal Work," the Administration is merely issuing circulars that serve to create impediments in the actual implementation of the courts' judicial verdicts. The Federation's President Rajendra Katoch, General Secretary Harkesh Chand, Chairman Gopal Dutt Joshi, Vice Presidents M. Subrahmanyam and Gurmeet Singh, and Secretaries Budhram and Hardeep Singh stated that the administration must immediately formulate a policy based on the judgment delivered by the Punjab and Haryana High Court on November 13, 2000, in CWP No. 17650-C of 1999, and implement it without delay. Furthermore, they demanded that, until such implementation takes place, the DC rates be revised on the same basis. In this regard, the Federation has announced its intention to launch a protest campaign, having formulated a strategy to mobilize all agitating groups across Chandigarh.
