EPFO Commissioner Issues Notices for Strict Action Over Alleged Exploitation of Outsourced Employees at CCET-26 Diploma Wing

Chandigarh 24 August ( Ranjeet Singh Dhaliwal ) : A significant development has emerged in favour of employee welfare regarding the alleged continued violation of labour rights and exploitation of outsourced employees at the Chandigarh College of Engineering and Technology (CCET), Diploma Wing, Sector-26, Chandigarh Administration. Taking cognizance of the voice raised and written complaints submitted by social worker Vikram Singh (The Voice of Fundamental Rights), the Employees’ Provident Fund Organisation (EPFO), Sector-17, Chandigarh, has initiated action and issued official notices for strict legal proceedings regarding alleged EPF irregularities.

The EPFO office has issued official communications for legal action against the outsourcing agencies M/s Sparrow Industrial Services and M/s Shine & Shine Security Solutions Pvt. Ltd. in connection with alleged irregularities relating to EPF contributions. The pending wages for 23 days during the tender gap from 11 August to 2 September 2024 should be paid to the employees immediately. As per Section 21(4) of the Contract Labour (Regulation and Abolition) Act, 1970, and the applicable Chandigarh Administration directions, the responsibility of the Principal Employer should be fixed if the contractor fails to make the payment.

Regular payment of salaries should be ensured between the 7th and 10th of every month, so that employees do not have to face unnecessary financial hardship. The withheld EPF refund of ₹3,600 allegedly relating to the previous contractor, M/s Shine & Shine, along with any EPF contribution-related lapses by the present agency, M/s Sparrow, should be resolved immediately and the eligible amount should be credited to the employees’ EPF accounts.

The practice of allegedly appointing a regular employee as a supervisor on Saturdays without any written order, as well as alleged favouritism and arbitrary allocation of duties, should be stopped immediately. The EPFO action has given a new hope of justice to experienced outsourced employees who have allegedly been struggling for their legitimate rights for a long time due to administrative delays and inaction by the concerned authorities. An appeal has been made to ensure strict compliance with labour laws, EPF and ESI provisions, fix accountability of the Principal Employer, and ensure the early resolution of all pending demands of the outsourced employees. The welfare and lawful rights of outsourced employees must be protected, and no employee should be deprived of their legitimate wages, social security benefits or dignity at the workplace.
