Public Interest Petition in High Court Over Compensation for 9-Year-Old POCSO Survivor
Chandigarh 12 August ( Ranjeet Singh Dhaliwal ) : The Punjab and Haryana High Court has issued notice on a Public Interest Litigation seeking relief under the Victim Compensation Scheme for a nine-year-old girl who was allegedly sexually assaulted. The next hearing in the matter has been scheduled for September 16, 2026. Advocate and Bar Council member Harpreet Singh Multani briefed the media about the development at the High Court on Wednesday. The PIL, CWP-PIL-217-2026, has been filed by Fight for Right – The Voice of Unheard Victims Welfare Society through its President. The petition raises the issue of ensuring relief to the child survivor of sexual assault under the victim compensation scheme and effective protection of her rights under the POCSO Act.
The case relates to Mand Maur village in the Kartarpur area of Jalandhar district. According to the information available, the nine-year-old girl was working in the fields with her parents when a 35-year-old labourer allegedly took her near the fields on the pretext of giving her papaya and sexually assaulted her. She was later found in a serious condition by the roadside. The family initially took the girl to a hospital in Kartarpur, from where she was referred to the Jalandhar Civil Hospital due to the seriousness of her condition. Doctors performed the required surgery during treatment. According to hospital authorities, her condition is now stable and she remains under observation.According to the police, the accused has been identified as 35-year-old Rajesh, a native of Jharkhand. A case was registered against him under relevant provisions relating to rape and the POCSO Act, and the police launched a search for him. The PIL primarily raises the question of how timely and effective relief can be ensured to a minor survivor of such a serious offence under the Victim Compensation Scheme. Simranjit Kaur Gill, president of the petitioner organisation, said there was a need to make the system more sensitive and accountable towards the rights and rehabilitation of child survivors. The matter will come up for further hearing on September 16, 2026.
